A settlement has been proposed in Dudo, et al. v. Capital One, N.A., d/b/a Capital One Auto Finance, No. 296-2020-CD (“Settlement”), which is pending before the Court of Common Pleas for Jefferson County, Pennsylvania (“Court”). The Settlement seeks to resolve a class action lawsuit against Capital One, d/b/a Capital One Auto Finance, (“Bank”) over whether the Bank sent proper notices to borrowers of their rights after the Bank repossessed their motor vehicles.
The Settlement, if approved by the Court, would provide several possible benefits to Class Members including (1) settlement payments and refunds, (2) compromise and extinguishment of disputed auto loan deficiency balances, and (3) credit reporting relief.
If you received a notice about this Settlement in the mail, you are likely a class member. Your legal rights are affected regardless of whether you act.
On July 6, 2020, the Court of Common Pleas for Jefferson County, Pennsylvania granted the Plaintiff’s Motion for Final Approval. Click here to view a copy of the Court’s Final Approval Order.
